Brazilian “GOLDEN VISA” for real estate investments

In Brazil, one of the possibilities to get a permanent visa is through real estate investment, which gives you the right to reside in Brazil indefinitely as long as the requirements set forth in Normative Resolution nº 36, dated October 9, 2018, as amended by Normative Resolution nº 46, dated December 9, 2021, of the National Immigration Council, are met.

Known in many countries as the “Golden Visa”, the investor visa is an option for those who have capital for investment and want to obtain a permanent residence in Brazil.

Intending foreign investment in the Brazilian economy, the country requires that interested parties use foreign funds to invest in a property, located in an urban area, worth R$1.000.000,00 or more – which currently corresponds to less than US$200,000.00.

However, when it comes to the purchase of real estate in the North and Northeast regions of the country, the minimum amount of investment foreseen can be up to 30% less than the total amount provided for in the Norm, that is, up to R$700.000,00 – which corresponds to less than U$140,000.00.

It is possible to qualify by purchasing two or more properties with a total value equal to the minimum value defined in the standard. Co-ownership is also allowed as long as each co-owner invests the minimum amount required.

The purchase can be of built or under construction real estate and the real estate documentation to be provided to the Ministry of Justice and Public Security, in order to obtain the residence permit, will be:

•         In case of built property:

a)          General Real Estate Registry, attesting to the ownership of the investor’s real estate, free of liens or charges;

b)          declaration from a credit institution authorized or registered in national territory with the Brazilian Central Bank, certifying the international transfer of capital for the acquisition of the real estate, by the value defined in the norm.

•         In case of building under construction:

a)          Contract of Purchase and Sale Promise of the property, duly registered;

b)          Declaration of a credit institution authorized or registered in national territory with the Brazilian Central Bank, certifying the international transfer of capital for the acquisition of the real estate property or for the payment, as a down payment on the Purchase and Sale Promise Contract, for the value defined in the norm;

c)           Construction Permit issued in accordance with Brazilian law; and

d)          Incorporation Memorial duly registered.

The residence authorization term can be up to 4 (four) years. After that time, the initial residence permit can be changed to an indefinite period, as long as the documents provided below are presented:

a)          documents provided for the initial authorization, as applicable, for the purpose of proving the maintenance of the investment conditions foreseen in the norm;

b)          copy of the National Migratory Registration Card (CRNM);

c)           criminal record certificates or equivalent document, issued by the competent judicial authority where he/she has resided during the temporary residence permit.

The real estate investor must remain in the national territory for at least 14 (fourteen) days, consecutive or interspersed, every two-year period, as of the date of registration with the Federal Police.
