The modernization of the copyright registration procedure in Brazil

Initially, it is important to clarify that copyright in Brazil does not require registration – that is, the right arises with the creation of the work by the author and regardless of formal registration.

In any case, it is common to see authors seeking to obtain such a record, as it can be a way of formalizing the creation and linking it to a date in time, which in turn may come in hand in any disputes involving the content created.

A disadvantage in obtaining the copyright registration, however, was the bureaucracy involved in the – then archaic – procedure by the competent bodies (mainly the Brazilian National Library) of receiving the necessary documentation.

This changed as of October 3, 2022: the National Library’s Copyright Office announced the digitization of all copyright registration processes, which must from now on be carried out through the Federal Government’s digital platform (Gov.br). Since the change, according to data made public, more than 250 new applications have been received.

This debureaucratization and facilitation of obtaining copyright registration in Brazil undoubtedly serves as an incentive for authors, and undoubtedly creates a positive impact on related industries – entertainment, arts etc.
